In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119, p. 1) – hereinafter referred to as the GDPR – we hereby inform you that:

Purposes and legal basis for processing

The purposes of processing your data have been specified. As the Data Controller, we will process your data:

  • to contact you based on your consent resulting from your initiation of contact with us (legal basis: Article 6(1)(a) of the GDPR);
  • to conclude a contract for the provision of our services, a development contract, a sales contract, or another contract falling within the scope of our business activities based on your interest in our offer or in response to your offer (legal basis: Article 6(1)(b) of the GDPR);
  • to perform a contract for the provision of our services, a development contract, a sales contract, or another contract within the scope of our business activities, once we have entered into it (legal basis: Article 6(1)(b) of the GDPR);
  • to comply with our legal obligations (legal basis: Article 6(1)(c) of the GDPR);
  • for analytical purposes [to better tailor our services to our customers’ needs, to generally optimize our products, to optimize service processes, to build knowledge about our customers, to conduct financial analysis of our company, etc.], which constitutes the pursuit of our legitimate interest in this regard (legal basis: Article 6(1)(f) of the GDPR);
  • for archival (evidential) purposes, which constitutes the pursuit of our legitimate interest in securing information in the event of a legal need to prove facts (Article 6(1)(f) of the GDPR);
  • for the purpose of potentially establishing, pursuing, or defending against claims, which constitutes the pursuit of our legitimate interest in this regard (legal basis: Article 6(1)(f) of the GDPR);
  • to conduct customer satisfaction surveys, which is a pursuit of our legitimate interest in determining the quality of our service and the level of our customers’ satisfaction with our products and services (legal basis: Article 6(1)(f) of the GDPR);
  • to offer you our products and services directly (direct marketing), which constitutes the pursuit of our legitimate interest in this regard (legal basis: Article 6(1)(f) of the GDPR).

Right to object

  • You have the right to object at any time to the processing of your data as described above. We will cease processing your data for these purposes unless we can demonstrate that we have compelling legitimate grounds for processing your data that override your interests, rights, and freedoms, or that your data is necessary for us to establish, exercise, or defend legal claims.
  • You have the right to object at any time to the processing of your data for direct marketing purposes. If you exercise this right, we will cease processing your data for this purpose.

Data retention period

  • Your personal data resulting from your contact with us may be archived. You have the right to request a copy of the correspondence you have had with us (if it has been archived), as well as to request its deletion, unless its archiving is justified by our legitimate interests, such as defending against potential claims from you. The retention period for data resulting from your contact with us will not exceed the period during which claims related to your contact with us may arise, i.e., 10 + 1 years from the end of the year in which you contacted us, where 10 years is the longest possible statute of limitations for claims, the additional year is for claims filed at the last minute and delivery issues, and counting from the end of the year serves to determine a single date for data deletion for contacts made in a given year.
  • Your personal data resulting from the contract you entered into with us will be processed for the period during which claims related to that contract may arise, i.e., for 10+1 years from the end of the year in which the contract expired, where 10 years is the longest possible statute of limitations for claims, the additional year is to account for last-minute claims and delivery issues, and counting from the end of the year serves to establish a single data deletion date for contracts ending in a given year.
  • We may process data for the purposes of direct marketing of our products and services until you object to its processing for this purpose or we determine that it has become outdated.

Recipients of the data

Your data may be accessed by third-party processors with whom we work, such as construction, accounting, legal, and IT firms, as well as entities with which we have capital ties.

Rights of data subjects

Under the GDPR, you have the following rights:

  • the right to access your data and receive a copy of it;
  • the right to rectify (correct) your data;
  • the right to erasure and to restrict processing;
  • the right to object to the processing of your data;
